North Carolina Autism Insurance & Ryan’s Law: What Parents Need to Know

One of the most common questions families ask when exploring ABA therapy is: “Will insurance cover this?” For most North Carolina families, the answer is yes — thanks to state legislation and federal protections. But understanding the details can save you time, stress, and surprises.

What Is Ryan’s Law?

Ryan’s Law is North Carolina’s autism insurance mandate, passed to ensure that children with autism spectrum disorder (ASD) have access to medically necessary treatments — including ABA therapy. The law applies to state-regulated private health insurance plans and requires coverage for:

  • Diagnosis of autism — including developmental evaluations and assessments
  • Treatment of autism — including ABA therapy, speech therapy, and occupational therapy
  • Pharmacy coverage — for medications prescribed as part of autism treatment

Important Note

Ryan’s Law applies to state-regulated insurance plans. Self-funded employer plans (common with large employers) are regulated at the federal level and may have different coverage rules. However, many self-funded plans still cover ABA therapy voluntarily or under the Mental Health Parity Act.

NC Medicaid Coverage for ABA

North Carolina Medicaid — including the state’s Medicaid Managed Care plans — covers ABA therapy for eligible children with an autism diagnosis. Key details:

  • A formal autism diagnosis is required (typically from a psychologist, developmental pediatrician, or qualified diagnostician)
  • Prior authorization is needed before services can begin
  • Coverage includes both BCBA supervision and RBT direct services
  • Re-authorization is required periodically based on continued medical necessity
  • NC Medicaid Managed Care plans (such as those through Healthy Blue, WellCare, AmeriHealth Caritas, and UnitedHealthcare) manage the authorization process

TRICARE Coverage for Military Families

North Carolina is home to major military installations including Fort Liberty (formerly Fort Bragg), Camp Lejeune, and Seymour Johnson Air Force Base. TRICARE covers ABA therapy for dependents with an autism diagnosis through the Autism Care Demonstration (ACD) program. Military families in NC can access in-home ABA services through TRICARE-authorized providers.

How the Authorization Process Works

Getting ABA therapy authorized typically follows these steps:

Autism Diagnosis: Your child receives a formal diagnosis from a qualified professional.
Provider Selection: You choose an ABA provider who is in-network with your insurance plan.
Insurance Verification: The provider verifies your benefits and confirms ABA coverage details.
Comprehensive Assessment: A BCBA conducts an evaluation and develops a treatment plan with recommended hours.
Prior Authorization: The provider submits the treatment plan to your insurance for approval.
Services Begin: Once authorized, in-home ABA sessions can start.

Tips for Navigating Insurance

1. Ask your provider for help — A good ABA provider handles insurance verification and authorization for you. You shouldn’t have to navigate this alone.
2. Get everything in writing — Request written confirmation of your benefits, including authorized hours and any coverage limits.
3. Know your appeal rights — If a claim is denied, you have the right to appeal. Your provider can help you through this process.
4. Keep records — Save copies of authorization letters, Explanation of Benefits (EOBs), and any correspondence with your insurance company.
